This User Agreement hereinafter referred to as the “Agreement” governs the relationship between you as a user of the digital platform “eMuseum Online” hereinafter referred to as the “Platform” and individual entrepreneur Matyash Dmytro Olehovych, who is registered and operates under the laws of Ukraine, is the owner of the Platform and provides the Services under this Agreement hereinafter referred to as the “Contractor” in the appropriate grammatical forms, and you as a user of the Platform hereinafter referred to as “you” or the “User” in the appropriate grammatical forms. The Contractor and the User may hereinafter be referred to jointly as the “Parties”, and each individually as a “Party”.
Acceptance of this Agreement is a mandatory condition for using the Platform. By using the Platform, you confirm your agreement with the terms of this Agreement.
1. Services
The “eMuseum” Platform, available at the domain https://emuseum.ua and related subdomains, provides registered Users with access to interactive materials: virtual exhibitions, video tours, digital archives, 3D models of museum objects, quests, and other cultural digital products hereinafter referred to as the “Services”.
The Services may be provided free of charge or on a paid basis. Information about access terms, prices, and the validity period of each Service is indicated on the relevant pages of the Platform.
The User confirms that they use the Platform exclusively for personal non-commercial purposes, in compliance with copyright and applicable legislation.
2. Registration and Account
To access certain Services, it is necessary to register a personal account on the Platform by providing accurate contact information. The User’s identifier is their email address or social media profile.
The terms and procedure for processing Users’ personal data on the Platform are defined in the Privacy Policy, which is an integral part of this Agreement.
The User has the right to delete their account independently by using the relevant option in the profile settings. After this, access to the Services linked to the account will be lost.
3. Terms of Use of the Services
The Platform provides Services in digital format, which may be limited by time, geolocation, or availability, in accordance with the terms of licensing agreements. Use of the Services is possible only through devices connected to the Internet.
The User confirms that they will not transfer access to the Services to third parties, distribute the Platform’s content beyond the scope permitted by its functionality, or copy or modify it without the written permission of the Contractor or the content rights holder.
4. Payment for Services
Where certain Services of the Platform are provided on a paid basis, payment is made through third-party payment services, in particular the LiqPay payment system or other services integrated into the Platform. The terms of use of such services are provided to the User during the payment process.
After successful payment, the User receives electronic confirmation at the specified email address. A paid Service is considered duly provided from the moment access to the relevant digital content is granted.
The User understands and agrees that payment for the Services is made through third-party payment systems, and the Platform is not responsible for possible malfunctions in their operation. In the event of technical issues with the crediting of funds, the User must contact the support service of the relevant payment service. The Contractor of the Platform, within the available technical capabilities, assists in providing information on the transaction status upon request of the User or the payment system.
The Platform has the right to introduce discounts, special offers, or other temporary promotional conditions.
The refund policy is determined separately and is available upon the User’s request.
5. Warranties and Liability
The “eMuseum” Platform guarantees that the digital materials posted on the resource are used in accordance with the current legislation of Ukraine, on the basis of relevant licenses or permissions from rights holders, and do not violate the rights of third parties.
The User is personally responsible for complying with the laws of the country of their location when accessing the Platform and using the Services. If access to or use of certain Services contradicts such laws, the User undertakes to refrain from using them.
The User confirms that they will not:
provide third parties with unauthorized access to the Services;
interfere with the operation of the Platform by technical or other means;
violate the rights of the Contractor or the rights holders of the Platform’s content in any other way.
The quality of content playback and access to digital materials depends, among other things, on the technical characteristics of the User’s device and the speed of the Internet connection. The recommended Internet connection speed for playing materials is 5 Mbps.
6. Intellectual Property
All content posted on the “eMuseum” Platform, including but not limited to texts, images, videos, audio, 3D models, interactive modules, interface design, logos, project names, as well as software, is the result of intellectual activity protected by the legislation of Ukraine and relevant international treaties in the field of copyright and related rights.
The rights to the relevant objects belong to the Platform, its partners, or other rights holders indicated within specific Services.
The User has the right to use the Platform’s content exclusively for personal non-commercial viewing and familiarization. It is prohibited to:
copy, modify, distribute, download, or store content in any form without the written permission of the rights holder;
use the Platform’s materials for commercial purposes, in public spaces, HoReCa establishments, as part of mass events or educational courses without approval from the Contractor;
provide access to digital products to third parties beyond the scope provided by the Platform’s functionality.
Any violation of the above terms may constitute grounds for civil, administrative, or criminal liability in accordance with the legislation of Ukraine.
The Contractor of the Platform reserves the right, without prior notice, to restrict or terminate access to individual digital materials, including in cases of changes to licensing terms or at the request of rights holders. If a Service has been purchased, access to it shall be maintained until the end of the established period, unless otherwise provided by the agreement or refund policy.
7. Other Terms
This Agreement governs the legal relationship between the User and the Contractor of the Platform and is interpreted in accordance with the legislation of Ukraine. All matters not directly regulated by this Agreement shall be considered in accordance with the current legislation of Ukraine.
The Parties agree that, in the event of legal disputes, such disputes shall be considered exclusively by the courts of Ukraine in accordance with the rules of jurisdiction.
If any provision of this Agreement is found to be invalid or to have no legal force, this shall not affect the validity of the remaining provisions of the Agreement. The Agreement remains in force in its current version until it is amended or cancelled.
Terms related to specific Services, including price, duration, access format, etc., may be changed only by mutual agreement of the Parties.
Other provisions of this Agreement may be changed by the Contractor unilaterally, of which the User will be notified by publication of the updated version of the Agreement on the Platform. Continued use of the Platform after the publication of such changes shall be deemed the User’s consent to the updated terms.
The Contractor also has the right to amend the terms of this Agreement in the event of changes to applicable legislation, contractual terms with partners, or requirements of the rights holders of digital content.
